This privacy notice (“Privacy Policy”) for Abode Financial Holdings, Inc. (“Abode”) ("we," "us," or "our"), describes how and why we may collect, store, use, and/or share ("Process") your information when you use the Services, such as when you visit our website at http://www.ownabode.com, or any website of ours that links to this Privacy Policy engage with us in other related ways, including by signing up for our products and any sales, marketing, or events.

The Privacy Policy is incorporated into the Terms of Service (the “Agreement”) between you and Abode. All capitalized terms used and not defined herein shall have the meanings ascribed to them in the Agreement.

Abode currently provides services only to residents of Texas or their authorized representatives.  If you are not a resident of Texas, you should not use our services.

Personal Information

Information we collect

In the course of offering and providing our products and services, it is common for us to collect personal information from and about our users, including financial and business information, some of which constitutes personal information. Generally speaking, personal information is any information that can be used, directly or indirectly, to identify, locate or contact someone. 

Types of personal information that we collect include but are not limited to:

  • names, 
  • physical addresses, 
  • mailing addresses, 
  • social security numbers, 
  • email addresses, 
  • phone numbers,
  • payment information,
  • driver’s license numbers, and
  • information contained within your utility bills, property tax documents, and property insurance documents. 

Under certain circumstances, personal information may also include other information that can reasonably link to a particular person, such as internet protocol (IP) addresses, unique device identification numbers, employment information, and internet activity. Personal information may include “Proprietary Information” as defined in 16 Tex. Admin. Code § 25.486(b)(5)).

We do not collect “Sensitive Data” as defined under 11 Tex. Bus. & Comm. Code § 541.001 (29).

How We Collect Personal Information

Typically, we receive personal information directly from you as a user or from your agents in the course of providing the Services. For example: 

  • You may provide your personal information to us in order for us to facilitate the appeal of your residential property tax assessment, your application for a retail electricity plan, or lowering your residential property insurance costs. 
  • If you set up an account on our website, we will collect information such as your name, email address, username and password, and we will receive any documents and information that you provide to us. If you register to apply for job opportunities through our website, we will collect your name, email address, password and phone number, and will receive any application information you submit. 
  • If you contact us through our website or telephone number for customer service or other purposes, we may receive your name, email address, any comments included in your message, and any oral statements that you make. 
  • Our web servers may also collect information from you such as IP address, browser type and version, time zone setting, operating system and platform. Some web browsers allow the user to send “do-not-track” signals to websites, but our website does not respond to those signals. Our website, like most websites, employs “cookies” and similar technologies. Cookies are small files that are stored on your computer or mobile device when you visit our website and allow us to recognize your browser and obtain information about your use of our website. 
  • If you decide to purchase any of our products or use the Services, we will process your payment information and securely keep it for audit/tax purposes and to prevent fraud. From time-to-time, we may contact you to see if you would like to take part in a research survey, provide feedback or a testimonial, or be part of a marketing campaign.

We may also collect personal information from third parties. For example:

  • If you log in via a third-party service like Facebook or Google, we will collect the information described in the third-party service’s request for authorization. 
  • If you access services provided by a business partner with whom we connect you, such as an insurance broker or agent, tax consultant, or retail electricity provider, we will collect information that the business partner provides to us in connection with your use of their services.
  • If you use our Services, we may collect information from companies or other sources that provide commercial information used to evaluate consumers for our Services such as payment history, electricity usage, insurance policy information, residential property tax information, or billing information. 
  • If a customer or business partner refers you to us, we may collect the information that they provide to us.

How We Use Personal Information

We use the personal information that we collect from you to provide our Services and to fulfill the purpose for which you provide it. For example, you may provide your personal information to us in order for us to facilitate the appeal of your residential property tax assessment, your application for a retail electricity plan, or lowering your residential property insurance costs. We may also use your personal information: 

  • to operate, maintain, and improve our Services; 
  • to provide you with information, products, or services that you purchase or request from us or our business partners; 
  • to provide you with email alerts, event registrations and other notices concerning our products or services, or events or news that may be of interest to you; 
  • to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections; 
  • to improve our website and present its contents to you;
  • for testing, research, analysis and product development; 
  • to communicate with you, including responding to your communications and other communications regarding your use of our Services;

We may disclose personal information we collect from you:

Business Partners

We may share your information with third-party business partners with whom we partner for the purposes of providing the Services and who may provide services directly to you at your request. These third-party business partners include but are not limited to insurance brokers, insurance carriers, tax consultants, retail electricity providers, and utilities. Third-party business partners may pay us a referral, lead generation, commission, share of revenue or other payment in exchange for their provision of their services to you.

Agents, Contractors, and Service Providers

We may share your personal information with our agents, contractors, and service providers on whom we rely on for the purpose of providing the Services and to maintain, improve, and inform our operations. These companies and individuals may include but are not limited to consultants, payment processors, data processors, data providers, and customer service providers. Some applications and services embedded within, or linked from, our website, such as maps and social media platforms, are controlled by service providers. 

Google Analytics and Other Similar Tools

We may share your information with Google Analytics or other similar tools to track and analyze your use of the Services. The Google Analytics Advertising Features that we may use include: Remarketing with Google Analytics. You can opt out of Google Analytics Advertising Features through Ads Settings and Ad Settings for mobile apps. Data Security

We maintain commercially reasonable administrative, physical, and technical safeguards designed to prevent any unauthorized use, access, processing, destruction, loss, alteration, or disclosure of the data and information you provide us. Unfortunately, transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to us through our website or other electronic means. To the extent allowable by law, any electronic transmission of personal information is at your own risk.

Third Party Practices

Third parties may use cookies, alone or in conjunction with other tracking technologies, to collect information about you when you use our website or navigate away from our website. They may also have privacy policies that differ from ours. For example, they may collect personal information about your online activities over time and across different websites, and other online services, and may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties or their privacy practices, and this Privacy Policy does not apply to any third-party website or service you may access through our website. If you have any questions about a third-party’s privacy policies or advertising, you should contact the responsible provider directly.

Non-Personal Information

This Privacy Policy does not restrict our collection, use or disclosure of any aggregated information or information that does not identify, or cannot be reasonably linked to, any individual.

Minors

We do not knowingly collect data from or market to children under 18 years of age.

By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.

Changes to Our Privacy Policy

We will post any changes we make to this Privacy Policy on our website. If we make material changes to how we treat personal information we collect from you, we will notify you by email or through a notice on our website homepage. The date this Privacy Policy was last revised is identified above. Your Texas Privacy Rights

If you are a Texas resident, Texas law may provide you with additional rights regarding our use of your personal information. We adopt this notice to comply with the Texas Data Privacy and Security Act, only to the extent applicable under 11 Tex. Bus. & Comm. Code § 541.002.

Rights

  • Right to Access: You have the right to know and see what personal data we have collected about you in a usable format.
  • Right to Delete: You have the right to request that we delete the personal data we have collected about you, subject to applicable legal exceptions.
  • Right to Correct: You have the right to request that we correct inaccurate personal data.
  • Right to Opt Out of Targeted Advertising and Sale of Personal Data: You have the right to “opt out” of “targeted advertising” and the “sale” of your “personal data” (as defined under Texas law).

Making Access, Deletion, and Correction Requests

Certain information may be exempt from such requests under applicable law. We need certain types of information so that we can provide the Services to you. If you ask us to delete it, you may no longer be able to access or use the Services.

Making Requests to Opt Out of Targeted Advertising or the Sale of Personal Data

We do not engage in targeted advertising or sell your personal data as defined under 11 Tex. Bus. & Comm. Code § 541.001.
